By accessing or using BAVE ("the Service"), operated by Benyamin Khodabandeh ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
You must create an account to purchase or activate a license. You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential. You are responsible for all activity under your account. Notify us immediately at support@benyaminkhodabandeh.ir of any unauthorized use.
BAVE offers three license tiers: Personal ($195), Pro ($395), and Enterprise ($4,999+). License keys are issued upon full payment via Parspal (our payment processor). Prices are in United States Dollars (USD) and are non-negotiable unless otherwise agreed in writing. Enterprise pricing is determined on a per-deal basis.
Upon purchase, you receive a unique license key that must be activated with a hardware ID (HWID) corresponding to the workstation on which the BAVE encoder is installed. Each license tier permits a specific number of registered workstations: Personal (1), Pro (3), Enterprise (unlimited). You may not share, transfer, or resell your license key except as expressly permitted under the Enterprise tier.
You may not: (a) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the BAVE encoder; (b) use the Service for any unlawful purpose or in violation of any applicable laws; (c) distribute, sublicense, or lease the software to third parties; (d) bypass or circumvent license enforcement mechanisms; (e) use the Service to process content that infringes upon third-party intellectual property rights.
We reserve the right to suspend or terminate your account and license immediately if you violate these Terms. Upon termination, your license key will be revoked, and you must cease all use of the BAVE encoder. Termination does not relieve you of payment obligations incurred prior to termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
To the maximum extent permitted by law, Benyamin Khodabandeh shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the license giving rise to the claim.
These Terms shall be governed by the laws of Iran. Any disputes shall be resolved in the courts of Tehran, Iran.
We may modify these Terms at any time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
